Welcome to LinkStacka! These Terms of Service ("Terms") govern your use of the LinkStacka website, mobile applications, and services (collectively, the "Service") operated by Andreas Zender Online Medien ("we," "us," or "our"), located in Germany.

LinkStacka is a social link hub platform that allows users to create customizable profile pages with links, media embeds, and other content blocks. Our Service includes:

• Creation and hosting of personalized link pages
• Analytics and visitor tracking
• AI-powered features for content optimization
• Media embedding (YouTube, Spotify, TikTok, etc.)
• Multi-language profile support
• Custom domain connections (paid plans)

3. Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

4. Subscriptions and Payments

Some features of LinkStacka require a paid subscription. By subscribing to a paid plan, you agree to the following:

4.1 Payment Processing

All payments are processed by Paddle.com Market Limited ("Paddle"), our Merchant of Record. By making a purchase, you also agree to Paddle's Terms of Use and Privacy Policy.

4.2 Billing

• Subscriptions are billed in advance on a monthly or annual basis, depending on your selected plan
• Prices are displayed in your local currency where available
• All prices are inclusive of applicable taxes (VAT, GST, sales tax)
• Paddle handles all tax collection and remittance on our behalf

4.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time through your account settings or the customer portal.

4.4 Refunds

We offer a 14-day money-back guarantee for new subscriptions. If you are not satisfied with the Service within 14 days of your initial purchase, contact us at legal@linkstacka.com for a full refund. Refunds are not available after the 14-day period or for subscription renewals.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Distribute malware, spam, or harmful content
• Harass, abuse, or harm others
• Impersonate any person or entity
• Engage in fraudulent activities
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the Service
• Promote illegal activities or violence
• Share adult content without proper age restrictions

We reserve the right to suspend or terminate accounts that violate these terms.

6. Intellectual Property

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• The results of using the Service will meet your requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANDREAS ZENDER ONLINE MEDIEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved in the courts of Germany.
